A wife of a senior RTO officer has been asked to show cause by the Office of the Commissioner of Commercial Taxes why proceedings for prosecution and penalty should not be initiated against her for trying to fraudulently evade payment of Entry Tax.
The show cause notice was issued to the RTO’s wife after she brought into the State a wheel loader from Dharwad and later submitted documents to the Registering Authority of the Directorate of Transport that the wheel loader does not attract any entry tax liability as per inquiries made with the Sales Tax department.
Assistant Commissioner of Commercial Taxes, V S N Gaunekar, in the show cause notice, however, pointed out that as per provisions of Section 3 of the Goa Tax on Entry of Goods Act 2000, the wheel loader being earth moving machinery attracts entry tax @ 2 per cent on its value.
“By informing the Transport department that no Entry tax is payable on said goods, you have tried to fraudulently evade the payment of tax due from you under the Act. You are also therefore required to show cause as to why the Entry Tax amount of Rs 57,000 should not be recovered alongwith interest amount of Rs 42,465 under Section 9 of the Act”, the show cause notice stated.
Gaunekar sought to know from her why proceedings for prosecution and penalty under Clause C of Sub section 2 of Section 41 of Goa Tax on Entry of Goods Act 200 should not be initiated for the alleged fraudulent act.
Hearing of the case will take place on July 2 and the Commissioner has called upon the party to deposit challan for Rs 99,465 in case she do not dispute the payment of the Entry Tax.
