Allowing the application filed by Adv Aires Rodrigues seeking court’s monitoring of the probe, the JMFC has directed the Crime Branch to file the first status report on September 4 and thereafter every 15 days till the end of the investigation.
Pointing to the JMFC that the police were deliberately flouting court orders when the accused are politically well connected, Adv Rodrigues had sought that the court monitor the investigation as the accused was politically very influential.
The complainant had drawn the court’s attention that despite over six months having elapsed since the FIR was registered that the police were acting as caged parrots and had intentionally and with malafide intention failed to investigate the case just to shield the accused despite the High Court also having clearly ruled that the 599 sq mts plot allotted to Dilip Parulekar was illegal and not in accordance with law.
On a petition filed under Section 156 (3) of the Criminal Procedure Code, the Mapusa JMFC had on January 16, 2014, directed the Porvorim Police to register an FIR for offences under sections 119, 120, 420 read with 120-B of the Indian Penal Code, against Dilip Parulekar, Peter Martins, then attorney of Comunidade of Serula and Irene Sequeira, then Administrator of Comunidade of Bardez and to investigate the matter.
The Porvorim Police accordingly registered the FIR on January 17 and then later on April 4 transferred the investigation of the case to the Crime Branch.
