PONDA: Four farmers supplying milk to Goa Dairy have filed a writ petition in High Court of Bombay at Goa praying for a stay on the annual general meeting (AGM) of Goa Dairy scheduled on September 2. The petition will come up for hearing on August 23.
The petition has been filed by Dattaprasad Savordekar, Jayanth Desai, Shivanand Pednekar and Vaibav Parab.
The respondents are the Goa Government, Registrar of Cooperative Societies, Goa Dairy MD, Goa Dairy Chairman, and Board of Directors of Goa Dairy.
According to the petitioners, the annual general meeting is illegal since the same is scheduled in defiance of the Registrar of Cooperative Societies’ order to convene a special general body to discuss the inquiry report on the losses suffered by Goa Dairy. The Registrar also directed that the special meeting take action against those responsible for the losses suffered by Goa Dairy.
The petitioners further said that one tenth of the members of Goa Dairy had also submitted a memorandum to the Registrar to issue order directing the Goa Dairy to convene a Special General Body to discuss the inquiry report.
However, the petitioners said, in violation of the Registrar’s direction, Goa Dairy board has convened an annual general meeting.
The petitioners pointed out that once one tenth of the members of Goa Dairy call for a special general body meeting, then, as per law it is mandatory to call such special meeting.
Therefore, the petitioners have prayed for stay on the annual general meeting, and instead direct the Goa Dairy to convene a special meeting to discuss the inquiry report and take action against those who caused loss to Goa Dairy.
