The Goa government’s notification of hikes in FAR rules for four and five star hotels is nothing but a devious move to permit more violations and illegalities. While the government is empowering the hotel and real estate mafias to get away with violations; government agencies, be it TCP or Directorate of Panchayats are issuing permissions that are not valid and in contravention to the law.
Corruption and the lack of accountability on the part of the government machinery drives these decisions. It is left to the common man to fight the government and the government authorities who are found to be empowering and orchestrating the violations by giving permissions that are in violation of the law.
Exposing the conduct of the officials in granting nod to construction activities of Goa Marriot Resort, the High Court of Bombay at Goa has recently held that the approvals for the hotel project are vitiated by malice in law and colourable exercise of power. “The authorities which are the custodians of power cannot be influenced in its exercise by considerations other than that for which the power is vested in them in the first place,” the High Court remarked.
This is nothing but sheer corruption and greed on the part of the government, TCP, Directorate of Panchayats and the village panchayats that form a nefarious nexus with the hotel and builder mafias.
We continue to see this in the classic Tiracol Golf Course Project that continues to rock Goa given the role our government and the government authorities are playing and which is a matter of litigation.
