3 years on, comunidade ‘land grabbers’ yet to be charged

CHICALIM: After Serula, the Comunidade of Chicalim is reportedly emerging as the biggest “den of corruption and land scam” as acres of its land are reportedly being disposed to builders and private citizens, flouting all existing guidelines set by the Code of Comunidades. A Herald investigation reveals that the comunidade’s regular executive committee members may have been allegedly enabling illegal land lease and sale of prime property often in alleged connivance with Chicalim Panchayat.

In another shocking development, Chicalim Comunidade’s executive members allegedly sold the prime sea-facing comunidade land to themselves where constructions too have come up. The police have failed to take any criminal action against the members. In August 2015, a resident Narayan Naik had filed a police complaint against Caetano Mascarenhas, Esther Sankhwalkar, Mahendra Salkar and Assis Nunes, the then president, attorney, treasurer, and ex-attorney of the Comunidade of Chicalim for allegedly grabbing comunidade plots in their favour.
Huge plots of land in Survey Numbers 137/0, 7/1 and 10/1 of Chicalim village belonging to the comunidade were allegedly transferred by Assis Nunes on behalf of the Comunidade to Caitano, Esther and Mahendra via sale deed and deed of transfer. When a complaint was filed before the Administrator of Comunidade in 2013, the Administrator suspended Esther from the post of Attorney and then forwarded the complaint to the Vasco Police. However, no FIR was registered. Subsequently, Narayan also wrote to the Police inspector of Vasco Police Station and the Superintendent of Police, South Goa but no FIR had been filed.
The then Administrator, Surendra Naik, in January 2015 had also directed the Comunidade of Chicalim to file a civil suit against the president and the treasurer before the competent court of law for declaring the deed of transfers as null and void. However, the comunidade General Body resolved that the judgement and the suspension of the attorney are unacceptable. No further action was taken by the administrator.
Meantime, the new “owners” of the comunidade plots have allegedly built compound walls around the plots and have even constructed three structures inside these plots.
The comunidade had subdivided the property bearing Survey Number 137/0 into 34 plots after taking permission from the PDA and Chicalim Panchayat. Plots of 400 sq mtrs were allegedly sold for Rs 4,22,000 to Mahendra, Caetano and Esther.
Interestingly, all these plots were allegedly divided without obtaining NOC from Administrator of Comunidade. In 2011, the comunidade had also resolved to subdivide properties bearing Survey Number 7/1(part) and 7/10 for which PDA technical approval was granted in June 2012.
Current station in charge of Vasco Police Station is yet to act upon this alleged criminal usurpation of community land.
