MARGAO: The Administrator of Comunidades, South Zone, has drawn up the final order of demolition of 56 houses in Talsanzor, on February 10.
According to the order, the illegal structures constructed and occupied by the petitioners on the land belonging to the Comunidade of Margao shall be demolished and the land shall be restored to its original condition within ten days of receipt of the order.
The paranoid residents of Talsanzor met Fatorda MLA Vijai Sardessai seeking help. The MLA has assured the residents to do all in his capacity to stop the demolition. The MLA also revealed that the local civic body MMC may also intervene in the matter.
The residents claim that only some of them received the orders asking for applications of regularisation and not all filed applications. Subsequently, the Comunidade in a meeting decided to go ahead and issue notices to the residents to vacate the houses. After some of the residents in the year 2013 petitioned the High Court of Bombay at Goa, directions were given to the Comunidade to consider the applications for regularization made by the petitioners in accordance with law, expeditiously and within a period of 12 weeks which did not happen.
In its order the Administrator says, “It is obvious that the construction activity has been unregulated and proceeded in a haphazard manner, in contravention of the law that regulates construction, and in particular planning regulations the house/structures and without proper facilities for sanitation, sewage and garbage collection or disposal, and poses a serious health hazard in the area. To regularize the same would set a naught the very purpose for which the law-makers enacted law to govern construction and development.”
