Aldona MLA decries ‘eyewash’ enforcement at Sunburn, threatens action through High Court

Questions why equipment was not seized and how sound levels were monitored at Sunburn; advocates strict action against nightclubs violating noise regulations

PANJIM: Terming the action by enforcement cell on day 1 of the Sunburn electronic dance music (EDM) for exceeding sound levels as a mere “eyewash”, Aldona MLA Adv Carlos Alvares Ferreira has threatened to bring to notice of High Court at next hearing about the failure to seize the equipment. He also pointed out that there were no equipment to differentiate which stage was exceeding sound decibel.

Speaking to mediapersons, Adv Ferreira said, “As per the High Court directive to the enforcement committee, there is no question of simply shutting down music without seizing the equipment. If such a situation continues, the law enforcement authorities must seize the equipment, and not simply stop the music. If they fail, they will be held accountable for it. Also, how was the sound reading taken, and how was the violation of a particular stage isolated and identified? I want the authorities to act in accordance with law. When the matter will come up in High Court as to what action should have been taken and or not and whether there was a violation of the high court order of compliance.” 

Speaking of another sound violation incident by a club in Vagator, Adv Ferreira warned such operators not to take Goans for granted. “Frantic calls were made by some residents in Vagator to me regarding a new nightclub that was playing music beyond 10 pm outdoors. The organisers later threatened them at their homes after a police complaint was filed, vowing to continue as ‘everyone is in our pocket,” he informed.

Warning the organisers, Adv Ferreira said, “Don’t take Goans for granted. Don’t think money can buy Goans out. Don’t think your money power will work with honest people. People need to live properly, and they must live a healthy life. You can’t expect them to suffer throughout the night because you want to make some money. It can’t be at the cost of the lives of the residents of the locality. We will bring this to the notice of the Court that these kinds of things cannot be accepted and tolerated where people who are suffering are complaining and at the end they get beaten up. This is completely wrong. These people who are coming here and playing music beyond 10 pm outdoors must be taken to task,” he said.

Adv Ferreira also highlighted another nightclub in Anjuna breaching the law with residents complaining and that even the recording of music playing beyond 10 pm was sent to him.
