MARGAO: Varca-based Alemaos might find themselves in the dock over the controversial digging of tarred land in front of their residence at Navangully-Varca, with an inquiry by Additional District Magistrate, South holding the tarred land digging activity illegal.
The inquiry conducted by the Additional district Magistrate, N S Navti has proposed to the government to acquire a six meter road for the complainant Sandra Mascarenhas under the Goa Building Regulations 2010.
Navti has submitted his inquiry report to the Principal Secretary, Revenue with a host of recommendations, including acquisition of six meter road for the complainant.
The Additional District Magistrate has said the road digging activity by the Alemao is illegal because there was no conversion of the nature of the land in question.
The Colva police have already registered offences under section 143, 147, 504 IPC, unlawful assembly, rioting, intentional insult with intent to provoke breach of trust and section 3 of Prevention of Destruction of Public Property Act, 1984 against Churchill Alemao, brother Ciabro and son Savio, besides nephew Warren in connection with the case.
In her complaint, Sandra Mascarenhas had alleged that the Alemao family formed an unlawful assembly and damaged public property. She alleged that Churchill, Warren, Ciabro and Savio dug up the tarred road leading to her house at Navangully, Varca using excavator opposite her main gate and also damaged the water pipe line to her house. She further accused Alemaos of threatening her family members and making it impossible for them to come out of house.
The Alemao’s, however, have denied the allegation. Churchill said he was free to dig up the tarred land since the property in question belonged to his family. He also criticized the police and the authorities for their interference in a civil dispute.
