Anjuna Zonnkar moves court to evict Sunburn organisers for non-payment of rent

Petitioner says Comunidade did not give any NOC to Sunburn; alleged that Sunburn organisers have habitually defaulted in making paayments; accuses Comunidade of not acting on complaint made to stop the “illegal construction work”

PANJIM: Roysal D’Souza, a Gauncar Zonnkar (member) of Comunidade of Anjuna on Thursday filed a writ petition praying to restrain and evict the Sunburn Electronic dance Music (EDM) organisers from using the land at Vagator without paying the full amount of over Rs 2.43 crore to the Comunidade of Anjuna for using the land for three days.

The three-day Sunburn EDM kicked–off at Vagator from Thursday. The petition is likely to be heard before the Vacation Judge of the High Court of Bombay at Goa on Friday.

The petitioner stated that the Comunidade of Anjuna in its extraordinary general body meeting on December 10, 2023 had unanimously decided to grant NOC to the Sunburn organisers – Spacebound Web labs Pvt Ltd only after receiving the full ground rent amount i.e. Rs 2,43,14,607 (Rs 2.43 crore) with a 15 per cent as security deposit for an area of 1,58,919 square metres.

The petitioner also stated that NO NOC was granted by the Comunidade to hold Sunburn from Dec 28 to Dec 30. The petition even stated that the Panchayat “has granted permissions to erect  the structure and setup for the music festival only on Dec 27

The petitioner further stated that he had filed a complaint dated December 15 before the Administrator of Comunidades, Mapusa against the Sunburn organisers to stop the ongoing illegal work carried out by them without obtaining NOC from the Comunidade of Anjuna.

The petitioner has also cited the Supreme Court order dated November 3, 2023, which has held that, “If permission is granted, the petitioner will pay the amount as demanded by the Comunidade by depositing the same with the Administrator of the Comunidade.”

The petitioner stated that this was not the first time that the Comunidade of Anjuna had been deprived of its own monies. The Sunburn event organisers had habitually defaulted in making payments and is continuing to do so as a custom. It is abundantly clear that they had no fear of law or the Courts and have time and again, blatantly, violated the laws.
