The injunction disallows Costa and Company from carrying out constructions on the land and from creating any third party rights to the property.
Developer Manjunath Dukle had also pleaded for a permanent injunction in the case to prevent any work at the site and to prevent sale and third party agreements of the property. Now, only the civil suit, which is underway, will decide the fate of the land and who develops it into what.
The applicant Dukle, who is the proprietor of Shrison Realtors, had pleaded that the revocation of the power of attorney be made null and void. The applicant had pleaded that the revocation has been only via a paper advertisement and he had not received any legal or court notice. He has also prayed to make the agreement of development as still in force.
Costa and Company Pvt Ltd had given a paper advertisement saying that it revoked the power of attorney of Dukle from the Aquem ground and later planned a project on the property. The advertisement on June 6, which was sent as a final notice to terminate the agreement between Costa and Shrison Realtors, was challenged by Dukle, who has now got relief. This property has been a focal point in Aquem for quite some years.
