The Goa Co-operative Societies (Amendment) Bill, 2010 which will hold the members of the committee and board of directors of a Co-operative society responsible for the decision they take during the tenure was introduced in the Assembly on Tuesday.
The Bill seeks to amend the Goa Co-operative Act, 2001 to enable any person or persons on whom all or any of the powers of the registrar are conferred to exercise the powers of the registrar.
The Bill also seeks to restrict holding of shares by members other than government or any other society or subject to relaxation to be granted by the government with reference to class of societies as notified to the extent of one-fifth of the share capital.
The Bill also seeks to amend the said Act so as to provide that a sum not exceeding 20 per cent of the net surplus shall be transferred to a deficit fund for meeting unforeseen deficits.
The Bill also seeks to hold the members of the committee or set up by the board of directors as the case may be, responsible for the decision taken by them during their tenure.
The bill also seeks to enable the registrar to undertake inspection of a society on his own motion.
The Bill also seeks to provide for appointment of additional president of the co-operative tribunal by the government.
Goa Municipalities (Amendment) Bill: The Bill seeks to make provision for the use of electronic voting machine at an election to a municipal council.
The Bill seeks to amend the Goa Municipalities Act 1968 for use of voting machines.
“Notwithstanding anything contained in this act or the rules, the State Election Commission may put in use the electronic voting machine in lieu of ballot paper at an election in such manner as may be specified by it,” the Bill says.
Amendment to Animal Preservation Act
The Goa Animal Preservation (Amendment) Bill, 2010 which seeks to make offences under the Act cognizable and non-bailable was introduced in the State Assembly on Tuesday.
The Goa Animal Preservation Act 1996, was enacted for the preservation of certain animals suitable for milch, breeding, draught or agricultural purposes.
The Act says that no person shall slaughter or cause to be slaughtered any scheduled animal in any place in the State, unless he has obtained in respect of such animal, a certificate in writing from the competent authority that the animal is fit for slaughter.
However, during the course of implementation of the Goa Animal Preservation Act numerous difficulties had cropped up, which the amendment seeks to solve.
The Bill seeks to empower the competent authority to enter, search and seize property without warrant.
The amendment also seeks to make offences under the act cognizable and non-boilable and make provision regarding punishment on conviction to a period of up to three yrs.
Moreover, the Bill also has provision for arrest of any person without warrant.
The Bill also seeks to provide for manner of disposal of seized property.
ADMINISTRATIVE TRIBUNAL: A Bill, which seeks to fix the maximum age of the president and additional president to hold the office of the administrative tribunal was introduced in the assembly.
The Goa Administrative Tribunal Amendment Bill, seeks to amend the Goa Administrative Tribunal Act 1965) to fix the age of the president and additional president to hold the office.
Commission for SC/ST
A Bill to establish the Goa Commission for Scheduled Castes and Scheduled Tribes to safeguard the interest of the Scheduled Castes and Scheduled Tribes – The Goa Commission for Scheduled Castes and Scheduled Tribes Bill, 2010, was introduced in the Assembly on Tuesday.
The Bill provides for the establishment of the Goa Commission for SC and ST to safeguard the interest of the SCs and STs in the state of Goa and the matter connected therewith.
The creation of new establishment is proposed to be implemented by the Department of Tribal Welfare.
The Bill empowers the Commission with the powers of the Civil Court, it also empowers the government to provide funds to the commission by way of grants.
The Bill also empowers the government to make rules for carrying out all or any other purposes under this Act.
