PONDA: The Additional District Judge Panjim sitting at Ponda, Bela N Nayak, acquitted the brother-in-law accused of rape and threatening charges by a woman at Ponda.
The Ponda Police had filed the offence against one Jayakumar Ragwan, resident of Ponda, for alleged rape and threatening a woman.
The charge against the accused was that on 2/12/2011 and after ten days thereafter, during working hours in the office of the firm in Ponda, the accused who was also the proprietor of the company, and brother-in-law of complainant/victim lady allegedly raped her two times in his office by asking her to stay back in the office on the pretext of finishing some pending work and also threatened her with dire consequences if she revealed about the alleged rape to anyone.
The prosecution examined four witnesses including the victim. The accused denied incriminating evidence against him and stated that the allegation was false and said it “is due to family dispute.”
The Court said the infirm, shaky and improbable evidence of victim lady cannot be believed at all and thus the prosecution failed to prove the guilt of the accused beyond reasonable doubt. Hence the Judge acquitted the accused of the alleged offences punishable under Section 376 and 506 –II of IPC.
