Casino extortion case: complainant prays for assisting lawyer

MARGAO: The complainant in the Mickky Pacheco casino-extortion case prayed to Margao Judicial Magistrate First Class (JMFC) Kalpana Gauns to appoint a lawyer to assist the public prosecutor in the case as the accused is a former minister and an influential person.

Mickky Pacheco and Mathew Diniz appeared before the JMFC on Saturday. Judge Gawas, after hearing the complainant Gerald Fernandes’ application, allowed the same. She asked him to appear before the court on September 8 with the assisting lawyer. Under section 302 of CRPC there is a provision to provide one such assistant.
While the hearing was going on, an argument broke out between Gerald and defense lawyer Anacleto Viegas over the alleged false and frivolous allegations he had made in his application seeking the assisting lawyer.
“The allegations mentioned in the application are false and frivolous, and I pray for the removal of the same. We are not against the allegations, but are against the faulty representation,” Adv Anacleto said in the court.
In the past hearings, Mickky’s advocate alleged that Mickky has been illegally, falsely and with malicious intentions implicated in this case and made to appear for five years. He also prayed for Mickky’s discharge from the case during the last hearing.
Goa Crime Branch officials had in September 2009 quizzed the then Tourism Minister Mickky Pacheco in connection with the casino extortion case registered against him. Mickky was booked by the Crime Branch on Sep 17 for allegedly extorting and assaulting a casino manager and staff and threatening them with dire consequences.
