CBI files indictment in Atala case, no allegations set

PANJIM: Central Bureau of Investigation (CBI) filed a chargesheet in the police-politician-drug-mafia nexus case in JMFC but none of the allegations of the FIR have been established due to a lack of evidence.

The CBI has filed a 112-page chargesheet on November 30 in the Panjim court against Police Inspector Ashish Shirodkar, then head of the Anti-Narcotic Police Station of cheating and forgery and using a SIM card which was obtained by forging documents. 
Shockingly, the CBI was not able to establish the NDPS and Corruption related charges as mentioned in the FIR copy. All other seven accused have been released after they were imprisoned for more than three months. Charges against PSI Punaji Gawas, Head Constable Hussain Sheikh, Constables Saish Pokle, Sandip Parab, Sanjay Parab and Ramchandra Kankonkar and alleged drug dealer, Yaniv Banian alias Atala has have been dropped.
However, the CBI has recommended departmental action against the officers since there is an absence of prosecutable evidence of FIR charges beyond reasonable doubt. CBI Police Inspector S S Parab who had finally chargesheeted the case has confirmed that the chargesheet has been filed in JMFC on November 30th as there were no appropriate sections to prosecute in the CBI or Special court.
During the course of investigation, it was found that Ashish Shirodkar used a SIM card which he obtained by forging documents of a lady from Bicholim. According to sources, it is learned that the photo identity and the photograph of the lady was sourced by the owner of Menezes pharmacy in Panajim where the lady was working and was given to Shirodkar. The documents were taken from the lady by the owner of the pharmacy for ‘official purposes’ by the employer. 
However, after receiving the document (driving license), Shirodkar changed the initial name, house number and driving license number using white ink and then xeroxed it and produced it before the service provider to obtain a SIM card. This is the reason why the CBI slapped him with sections 420, 468 and 471 of the IPC. 
It has also been noticed that the whistler blower of the Police Politician Drug Nexus, a Swedish Model called Lucky Amori who was an alleged girlfriend of Atala has deposed before the CBI through Interpol and denied the uploading of the video on ‘Meta Cafe’ in which Atala was seen confessing giving bribes to Police Officers. 
The CBI, on February 22, 2010 registered the case against 7 police officers and Atala after local media exposed the said video and on June 22, 2011 it was transferred to CBI based on the direction of the High Court. Since then the case was under 3 police inspectors – Ashok Yadav, Ashish Chawan and S S Parab.            
Former Home Minister’s son Roy Naik was allegedly linked with the case and the CBI also interrogated him.
