Colva property demolition stayed

NEW DELHI: The Supreme Court on Friday ordered status quo, staying the National Green Tribunal’s approval of the demolition of a property of one Soshil Kumar Vaid in Colva.
The Bench of Justices Rohinton Fali Nariman and Surya Kant also issued notice to the Goa Coastal Zone Management Authority (GCZMA), which had ordered demolition of the construction done on the property.
Vaid had come in appeal against the ruling of the Principal Bench of the National Green Tribunal headed by Justice Adarsh Kumar Goel on April 3, 2019, rejecting his appeal against the GCZMA’s order for demolition of the construction.
The Tribunal had ruled that the documents produced by Vaid before the authority were not sufficient to conclude that the construction was in existence prior to February 19, 1991 when the CRZ Notification of 1991 came into force. 
Further, it noted that the building in question to be demolished is a new structure and Vaid could not produce any documents to show permission granted by the authorities.
On this ground, the tribunal held that the authority rightly directed demolition of the building after stopping the commercial activity there and it finds no reason to interfere with the findings of the authority.
