PANJIM: The Special Court has rejected Crime Branch’s (CB) plea seeking permission to conduct a narco analysis test on former PWD minister Churchill Alemao and sacked JICA Project Director Anand Wachasundar in the Louis Berger bribery scandal.
However, the investigation agency has been allowed to file a fresh petition to seek permission to carry out the same test on former chief minister Digambar Kamat. The application is likely to be filed on Thursday.
Sources said the petition was turned down after both accused, who spent more than two months in jail, did not give consent for the test. “There has to be consent from the accused only after which the court grants permission to conduct the lie detector test,” a senior official said.
CB has already moved the Supreme Court seeking cancellation of anticipatory bail to Kamat and final arguments have been slated on December 8. Kamat was issued a notice in response to the petition.
It has been pointed out that the High Court of Bombay at Goa and Special Court failed to consider the merits of the case while granting Kamat anticipatory bail. It has also been brought to the court’s notice that his custodial interrogation was necessary to recover the notings from the missing JICA files as well as the bribe amount, that he is alleged to have received as kickback from the LB executives.
