MARGAO: The High Court on Monday issued directions to the Administrator of Comunidade that on February 17, Damodar Naik shall be declared as the President of the Managing Committee of the SancoalComminidade. Damodar Naik was the only nominee to the post. The court order states that no fresh nomination shall be invited and no fresh elections shall be held for the post.
The Court further ordered that for the post of President Substitute, Treasurer, Treasurer Substitute, Attorney and Attorney Substitute, no fresh nominations shall be accepted and the elections are to be held on the basis on the nominations received and accepted on 2nd December 2018.
In its order, the Honorable High Court came down heavily on the Mamlatdar who was the presiding officer. In the order, the Judges stated that “we are surprised as to why the Mamlatdar permitted distribution of 41 ballot papers to votes/shareholders of the Comunidade in the election hall. Normally the names of the voters have to be called out seriously and as and when they come forward to vote, and after verifying their identity they have to be issued the ballot papers”.
The order states the record indicates that there was no actual law and order situation. The court called out the actions of the authorities to postpone the election stating that the postponement of the election is an extremely serious matter and from the minutes placed on record, it is apparent that none of the authorities have treated the issue of postponement of the elections with the seriousness in deserves.
