MARGAO: The Administrative Tribunal has struck down the election of Camilo Barretto as the President and his nephew Vicent Barretto as substitute president of Davorlim Comunidade in an order pronounced on March 1, 2017.
The order was pronounced in the case filed by Joao Xavier Carmo Santana Miranda who had unsuccessfully contested the said elections held on January 24, 2016.
Joao Miranda had filed the petition against the elections on grounds that neither Camilo Barretto nor his nephew Vicente Barretto could contest the elections as they did not have requisite shares. They had only three shares as against the required shares of five to contest the elections.
He also argued that the petition was necessitated because the talathi appointed by the Collector to conduct the elections did not consider the objection to their nominations when it was raised at the time of elections and allowed the elections to be held even though the two were not eligible to contest then.
The Administrative Tribunal while dismissing the Respondents’ plea that the petition against elections should have been decided within eight days of the elections, observed that it was “not only difficult but impossible to comply with the time limit of 8 days” given the fact that the proper procedure of law like issuing notice and giving time to respond has to be complied with.
While setting aside the election of Camilo Barretto as president and his nephew Vicent Barretto as Substitute President, the Administrative Tribunal has asked the Administrator of Comunidade to hold fresh elections to the two posts.
Although the petition was also filed against Leoncio Raikar who was elected Attorney and Silvestre Niasso who was elected the Treasurer and also the Comunidade of Davorlim, no relief was sought against them and hence there was no order with regards to them.
