PANJIM: The High Court of Bombay at Goa will pronounce on Friday the verdict in the Crime Branch (CB) application seeking to quash and set aside the special court order granting former chief minister Digambar Kamat anticipatory bail in the Louis Berger bribery case.
During final arguments before the single judge bench of Justice C V Bhadang on Tuesday, defence counsel Surendra Desai contended that Crime Branch needs Kamat’s custodial interrogation to forcibly record his statement.
“I cannot be forced to depose against myself as per law,” he said arguing for his client.
Public Prosecutor S Rivonkar on the other hand stated that recovery of missing JICA file is crucial to unearth the entire conspiracy and mentioned that the lower court granted him anticipatory bail merely on technical grounds by ignoring the facts of the case.
He stated that Kamat refused to cooperate during questioning, thus his custody is required.
The defence then pointed out that bail had been granted to former PWD minister Churchill Alemao and sacked JICA project director Anand Wachasundar, which was contested by the PP claiming Kamat has not been chargesheeted like the two accused.
The bench reserved the order for Friday afternoon.
