The earlier judgements held that plans, which the respondents relied upon for the legality of the constructions made were invalid. The judgements quashed the approvals granted.
The presiding judge of the first division bench (Justice Roshan Dalvi) which heard the matter and delivered judgement on February 26, 2014 ordered demolition of the impugned constructions. However, though the second judge, Justice F M Reis, agreed that the plans were substituted, he referred the matter to the Town Planning (and the GCZMA) for a decision.
The PIL was referred to a third judge (Justice U V Bakre) who decided with Justice Reis. The majority view, required the Town Planning and Village Panchayat to take steps to examine whether these constructions could be saved as per laws and regulations valid at that time.
In 2017, the Town Planning Department finally submitted a report that indicates the buildings (which house the Grand Hyatt) cannot be saved.
