MARGAO: The Special Court, Margao will on Monday hear the bail application of arrested former Canacona Municipal Council Dipak Desai, even as the Crime branch has vehemently opposed the bail plea on grounds the officer is required in custody to ascertain alleged illegal gratification received by him in the case.
In its reply filed in the special court, the Crime branch said the accused had played a major role during his tenure as chief officer while issuing the construction licenses and approvals in 2010. “On inspecting the relevant files, it is observed from the noting prepared by the officer, that he had approved the files without properly scrutinising and verifying the documents and holding the mandatory inspections,” the crime branch said.
The investigating agency has further submitted that vital documents such as structural liability certificate, RCC drawings and the RCC design calculations are not available in the files cleared by the officer. “Prima facie, the accused has committed breach of his official duties by clearing the file bypassing the procedure for the purpose of gaining valuable advantage as against the public interest,” the Crime branch has told the court.
