Final order in French actor’s case to be pronounced on February 21

MAPUSA: The hearing into the application for temporary injunction filed by beleaguered French actress Marianne Borgo has been completed and the final order will be pronounced on February 21.

The application for temporary Injunction was taken up for hearing on Tuesday before the Judicial Magistrate First Class (JMFC), Mapusa. 

Adv Benny Nazareth, the lawyer representing Borgo during the last hearing had produced documents.

He claimed that Borgo is in possession of the house including agreements, acknowledgement issued by late Francisco D’Souza.

D’Souza  entered her name thereby giving her the possession of the house and a certificate of registration was issued by FRRO in 2009.

The other party argued that the court should not take into consideration the documents because the agreements were not registered.

Adv Nazareth pointed that that the agreements under the law need not be registered under Section 17 of the Indian Registration Act while only the sale deed is to be registered.

The lawyer representing other party further argued that the stamp duty used for agreement was insufficient to which Adv Nazareth responded saying that when the agreements were executed in 2005, the stamp duty was only Rs 10. 

The other party further said that all the agreements are all bogus to which, Adv Nazareth said that all the stamps for the agreements were bought by Francisco Sousa so how could Marianne who entered the house in 2009 fabricate the documents in name of Souza, which were made in 2005.
