MARGAO: The Margao Town Police have filed a first information report (FIR) on March 25, against Mohammad Kadar and his son Thajaudin alias Taj Kadar for allegedly trespassing and occupying a flat following a complaint by Ralph Barbosa.
In his complaint, Ralph said the flat on the first floor of Silver Strip Green House building near the ESI Hospital belonged to his uncle the late Fr Norman Barbosa who expired on February 2, 1994. After Fr Norman’s death his assets devolved to his two brothers Joao Francisco Edmundo Barbosa and Edwin R J Barbosa following a Deed of Succession dated June 2, 1994. Following the death of Edwin Barbosa on December 24, 2005 his assets devolved to his son Ralph vide a Succession Deed dated May 29, 2006.
Hence the flat devolved to Ralph and he was maintaining it by cleaning it every six months and carrying out minor maintenance work. However, when he visited the flat on February 27, 2019 he was shocked to see the front door open and some males in the house.
In his complaint he also mentioned that the ancestral teakwood furniture that was there in the house such as dining table, coffee table, 6 chairs, etc. were missing and when he sought to question the occupants how they got into the flat, they pushed him out and shut the door.
Ralph filed the initial complaint on February 28, 2019 and as no action was forthcoming from the police, he submitted a reminder on March 22, 2019 following which the investigations commenced and PSI Sujay Korgaonkar was handed over the case.
According to Sujay, the Kadars are now claiming that they had purchased the flat from Fr Norman before his death but when asked to produce the purchase document, they only provided some photo copies and hence the case is still under investigation.
The PSI said if the Kadars fail to produce the purchase document to prove that they have purchased the flat, he will have to file a case in the court which will then decide on the ownership of the flat.
It may be recalled that recently a similar fate befell on Chris Perry’s Glenn Perry as he found some strangers occupying his flat while he and his brothers are working abroad.
