PANJIM: The Goa Coastal Zone Management Authority has directed M/s
Palacio Property Developers Pvt Ltd to stop work at its housing
complex at Goa Velha and show cause ‘why a direction should not be
initiated against it to demolish the structures and to restore the
land to the original condition.’
The action has been initiated on the basis of a complaint filed by
one Niraj Naik, who had alleged that the construction is within
the NDZ of the CRZ 2011.
An inquiry earlier conducted by the inquiry committee of the GCZMA
found that “the major portion of the ground plus three structure
on the western side which is under construction, a part of the on
the Eastern side, jetty on the Southern side of the bank of the
river and the cemented compound wall on the eastern side falls
within the NDZ line demarcated in the site plan.”
The inquiry committee gave equal opportunity of being heard, both
the complainant as well as the representative of the violator.
The stop work order also shows that the developers have not
received any prior permission from the GCZMA for the construction
and hence it is wholly illegal.
The stop work order however does not give the violator any time
frame within which to file a reply even as it warns that “If you
fail to submit your reply along with required documents, the GCZMA
will come to the conclusion that you have no justification to
carry out activities and the authority shall proceed to issue
final directions to you without any further notice which could
include demolition order, disconnection of water, power supply,
cancellation of permissions, etc.”
