GHRC disposes complaint by lawyer against a builder

PANJIM: The Goa Human Rights Commission (GHRC) has disposed of a complaint filed by a city lawyer against a builder. 

Adv Noel Dias Sapeco had filed a complaint dated May  8, 2014 with regard to the forcible and deliberate closure of the underground parking of the building premises of Edcon Towers, Panjim thereby violating the basic human rights.

Sapeco stated that he was a senior citizen suffering from arthritis and had to hunt for parking outside the complex. He approached the Commission for necessary action against the builder for committing gross violation and deprivation of his human rights. 

The CCP commissioner in his reply stated that it had started proceedings on the complaint and the matter is pending adjudication. He also stated that the complaint was a civil dispute between the complainant and the developer/builder with regards to allotment of parking and that the present proceedings are not maintainable. 

During the course of the proceedings, the Commission impleaded the builder, who said that as per Deed of Sale, the complainant had agreed that all rights to the car parking in the basement shall belong exclusively to the former and that the complainant was not allotted any car parking in the basement. The complainant had also agreed that he shall not use any slot in the basement for parking his vehicles.

The three-member panel found that the dispute raised by the complainant is a civil dispute and that the NGPDA and the CCP had not violated any human rights of the complainant.
