Goa Board has sought legal opinion on cancelled public exam: Shetye

PANJIM: The Goa Board of Secondary and Higher Secondary Education (GBSHSE) has sought legal opinion to validate its decision to cancel the Class X and XII board examination.

The GBSHSE chairman Bhagirath Shetye told Herald that the Board is in talks with the legal team to validate its decision to cancel the public examination.

“There are certain provisions in the Act which we are discussing. The legal team will guide us on this,” Shetye said responding to a question with regards to a memorandum submitted by a regional political party claiming that the cancellation of the examination has no legal and constitutional sanctity as there is no such provision in the GBSHSE Act or Rules.

In view of COVID-19 pandemic, the Goa Board cancelled the Class X and XII board examination. While the Class X students will be promoted based on internal assessment, the well-defined criteria will be put in place to assess Class XII students.

Meanwhile, a regional political party on Tuesday demanded an ordinance amending the Goa board of secondary and higher secondary education act of 1975.

The party has submitted a memorandum to the Chairman of the Goa Board of Secondary and High Secondary Education.

“It is the responsibility of GBSHSE to ensure that students are fully protected from any possible future discrimination in the matters of higher education, scholarships, fellowships, awards or employment”, the memorandum stated.

The party further said that the announcements made by the Chief Minister of cancellation of the Class X and XII does not have legal and constitutional sanctity as there is no such provision in the existing Goa Board of Secondary and Higher Secondary Education Board Act or GBSHSE rules.
