PANJIM: The events leading to the brutal attack on Adv Gajanan Naik by policemen are getting murky.
In the middle of it all is the revelation the contentious flat in question over which the murderous attack on the lawyer was committed was both bought and sold by the wife of Deputy Superintendent of Police Ashish Shirodkar.
The flat is called Peace Heaven in Porvorim, which has seen no peace.
When the flat was sold to Sanmati Vijaykumar Ghongade, by the wife of Ashish Shirodkar, then PI now DySP, his name was also on the deed where he mentioned his profession as “businessman” and not a government servant in the employment of the Goa Police.
Importantly the JMFC Court in Mapusa had declared both the purchase of the flat by Shirodkar’s family and then the sale of the same flat as illegal and annulled both the transactions.
Documents of every detail of the sale purchase, with signatures and photographs and court orders, pertaining to this flat are in possession of Herald
Documents and correspondence show that the entire controversy centres around the double illegal sale of a flat — first by Zena D’Souza to Mrs Shirodkar (Maria Linette Pereira), on 17/1 /2008.
On 18/04/2012 Mrs Shirodkar and her husband Ashish Shirodkar, who in turn signed a Deed of Sale with Sanmati Vijaykumar Ghongade.
Surprisingly Ashish Shirodkar despite being a police officer has stated in the Deed of Sale that he is a businessman.
ENTER DIOGO PINTO, the original owner, represented by his lawyer Adv Gajanan Sawant, who got assaulted brutally allegedly by the Porvorim cops
This ultimately turned out to be a purported case of “flat grab” when Diogo Pinto, belonging to the family of the original owners of the flat, of Alto Porvorim, approached the Civil Court, Mapusa, and obtained a Decree the said flat, now in the name of Vijaykumar Ghongade, sold to him by the Shirodkars, as null and void and the possession was handed over to Pinto. Adv Gajanan Sawant is Diogo Pinto’s lawyer.
Events leading up to the climax
Before the legal implications and the court decree came into effect Ghongade had handed over the possession of the flat to four students on a monthly rent. But Diogo Pinto (original owner’s family) son Richard approached the students and told them that he had obtained a decree of ownership in his favour. Considering this, the students requested Pinto to execute a leave and licence agreement in their favour for five months till their academic year ends and accordingly leave and licence agreement was signed on 5/12/2022 and a copy was submitted to the Porvorim Police Station.
The students later informed Richard Pinto son of Diogo Pinto (original owner and now in possession) and vacated the flat and handed over the possession to Pinto.
Adv Gajanan Sawant in his statement has mentioned a conspiracy between Ghongade and Ashish Shirodkar to illegally get back the flat now is possession of the original owner and Adv Sawant’s client, Diogo Pinto.
Criminal conspiracy to illegally get the flat back hatched by DySP Shirodkar and Ghongade: Adv Sawant
PANJIM: Adv Gajanan Sawant on Tuesday alleged that DySP Ashish Shirodkar, head constable Sandeep Parab alias Kamin and Vijaykumar Ghongade hatched criminal conspiracy to forcefully and illegally dispossess his client (Diogo Pinto) from his flat and to assault him.
In a written statement to the Crime Branch investigating officer, Adv Sawant said, “In pursuance of the said criminal conspiracy, Parab and three unknown constables (out of which two were in uniform) and Ghongade and his wife formed an unlawful assembly, abused and assaulted me with the intention and knowledge to kill me and threatened me with dire consequences.”
Adv Sawant stated that he had gone to the spot at the request of his client where he was abused by Sandeep Parab alias Kamin in filthy language and gave dire consequences before assaulting him with a wooden plank. The other constables too joined and assaulted with kicks and then pushed into the rear seat of a car and again assaulted him.
Adv Sawant has further stated that Sandeep Parab along with DySP Ashish Shirodkar was accused and both were attached to ANC Police Station and were good friends. Also DySP Ashish Shirodkar and his wife had executed the Deed of Sale dated 18/4/2012 and received Rs 20 lakh from Ghongade. DySP Shirodkar had also mentioned his occupation as businessman and concealed from the government the income of Rs 20 lakh received as consideration from Ghongade, he said in his statement.
‘I am nowhere involved’: DySP Ashish Shirodkar
Denies he has anything to do with the incident that led to the alleged assault on Adv Sawant; non-committal on why he called himself a businessman and not a police officer on the sale deed of the flat
PANJIM: DySP (Traffic) Ashish Shirodkar on Tuesday strongly refuted allegations made by Adv Gajanan Sawant and claimed that he had nothing to do with the incident.
When contacted, DySP Shirodkar said, “I am nowhere involved in the case. My wife (Maria Linette Pereira) had purchased the flat. We stayed in the flat for about four years and sold it in 2012.”
He also claimed that he was unaware of the ongoing litigation when the flat was purchased by his wife in 2008. “I was a co-owner when the flat was sold,” he said, and remained non-committal about him mentioning his occupation as ‘businessman’ in the Deed of Sale.
