PANJIM: The Nationalist Congress Party, in a memorandum submitted to Governor B V Wanchoo, called on him not to give his assent to the ordinance which seeks to supercede the power of managing committee and administrator and appointment of an OSD for comunidades.
It argued that instead a commission headed by ‘a person having status of retired high court judge having vast knowledge about the issue pertaining to comunidade and its institutions,’ be appointed. It wants the commission to investigate into the management, financial illegalities and allotment of plots ‘with the special reference to fast track to probe, enquire, investigate into illegal allotment of plot of land to the Cabinet Minister Dilip Parulekar who is presently the Minister of Tourism.’
NCP has promised to present before the commission, if it is appointed “evidence also obtained from the Civil Court which prima facie suggests that the said minister even has deposed falsely to grab the land and plot of Comunidade of Serula.”
The memorandum also wants the Governor to direct the Chief Minister to make public the report submitted by R L Bhobe & Company.
According to the NCP, the working of all comunidades is regulated in terms of the procedure contemplated under the Code of Comunidade by the managing committee elected as per the Code of Comunidade. “It is these managing committees which have all the powers to safeguard the interest of the comunidade properties and institutions of comunidade in terms of Article 30,’ says the memorandum adding, “The rights/power of the managing committee and its individual working body are analyzed in the Code of Comunidade and who works under the control of administrator of respective zone.” The Administrators are appointed by the government.
The memorandum alleges that the report submitted by a Chartered Accountant Firm R L Bhobe & Company, has reported to the government about the irregularities in the management of finance and allotment of plots belonging to the Comunidade of Serula. And based on the same report of one such comunidade, the government is intending to come with a draconian ordinance with an intention to saffronize the entire institution of comunidades in State of Goa which otherwise enjoys an autonomous status.
The memorandum further alleged “that Dilip Parulekar, present minister has illegally and unauthorizedly diverted the comunidade plot having an area of 599 sq mtrs situated at prime location in his name….” and claimed that they had enough “evidence to show how the minister has misused and abused his power to acquire the said land illegally in his name by bypassing the settled law.”
