PANJIM: The High Court of Bombay at Goa has allowed possession of a land to its leaseholder, which was granted 112 years ago.
The Comunidade of Chorao had claimed ownership of the land measuring 12,000 sq mtrs given on lease 112 years ago arguing that leaseholder Domingos D’Souza had abandoned the property and did not put it to use. However, the court held that the comunidade had granted definite possession of the land to the leaseholder and that the amount was also paid to the authority.
The comunidade stated that the leaseholder did not pay the stipulated ‘foro’. The High Court observed there is no provision for reversion of the land granted on aforamento basis, once the final/definitive possession is delivered.
