HC converts writ petition into suo moto

PANJIM: The Goa Coastal Zone Management Authority (GCZMA) and the Anjuna-Caisua Village Panchayat demolished the illegal structure on Anjuna even as the High Court of Bombay at Goa has asked them to find out the status of all such similar structures built on the beach.

Following the High Court directives, the GCZMA and the village panchayat demolished the newly built illegal structure and produced photographs of the same to the Court on Wednesday.  

The construction had come up in No Development Zone (NDZ) without any permission from any authorities. Despite complaints by petitioner Ramesh Muzumdar, the panchayat authorities had refused to act. The Anjuna police authorities went to the site and stopped the works but the works resumed after the police returned. 

Ayush Choudhary and Mritunjay Tiwari, who had reportedly carried out illegal construction were also present in the Court, had given an undertaking that they will immediately commence the demolition of the illegal structure and file a compliance report. At their request, the Court allowed them to take away the material used by them for putting up the illegal construction. The duo also told the Court that they will clear the debris from the beach. 

The Court earlier ordered the removal of the seal to demolish the illegal portion of the structure while the rest of the seal will continue since there is an issue as to whether a restaurant behind the illegal structure which is now to be demolished is legal or not. That is the matter which will have to be inquired into by the authorities, the Court said.

In the affidavit, owner Augusta D’Souza pointed out that there are several constructions by the side of the illegal construction by her or by Choudhary and Tiwari. She stated that other illegal structures cannot be allowed to remain on the beach.
