HC declines to accept former Tourism Minister’s plea to quash Addl District and Sessions Court order

PANJIM: Declining to accept former Tourism Minister Dilip Parulekar’s plea to quash the order passed by the Additional District and Sessions Court, Mapusa in the alleged grabbing of Comunidade of Serula land by him, the High Court of Bombay at Goa directed both Parulekar and complainant Trajano D’Mello to appear before the Additional Sessions Court, Mapusa on March 18, to decide the criminal revision application on merits within next three months.

Disposing of a criminal writ petition filed by Parulekar, the High Court observed that the matter was languishing since 2017 on account of a stay granted to the impugned order on January 7, 2020.

By an order dated October 14, 2015, the Judicial Magistrate First Class (JMFC), Mapusa had directed the Porvorim police to register an FIR in terms of the complaint filed by Trajano on October 18, 2015 in exercise of powers under Section 156 (3) of the Cr.P.C. 

However, the Porvorim police appealed against the JMFC order and the Sessions Court directed the JMFC to reconsider it. But Trajano challenged it again before the Sessions Court, who in 2017 found that Parulekar and two others had ‘appropriated’ the Comunidade land.
