PANJIM: The Bombay High Court Bench on Thursday directed the Goa State Coastal Management Authority (GCZMA) to seal the premises of Toy Beach Club, Candolim.
The High Court also directed the respondent Shrem Resorts Pvt Ltd not to carry out any commercial activity at Toy Beach Club in Candolim and pulled them for “the blatant falsity” in an earlier affidavit that was filed by them.
“It is shocking that the respondent could file a false affidavit, misleading the Court,” said Bench of Justice Revati Mohite Dere and Justice M S Jawalkar.
The High Court directed the Additional Government Advocate to communicate the said order forthwith to the concerned officer of the GCZMA as well as the police so that commercial activities which are taking place at the aforesaid property are stopped immediately.
The main petitioner in the case is Roshan Mathias.
“Although, the respondent had sought time to file an additional affidavit, that no construction activity was being carried out, having regard to the petitioners’ allegation, no affidavit is forthcoming. It appears that the said affidavit is not filed, as there is substance in the allegations made by the petitioner with respect to construction activities going on at the aforesaid place, i.e. property bearing survey number 146/4-E of village Candolim,” said the Bench.
It pointed out that the respondent had earlier submitted an affidavit where it had specifically stated that no commercial activities were being carried out in the property based in Candolim. The counsel for the petitioner, Adv Anamika Gode, submitted to the Bench photographs of the event, which was supposed to take place between December 9 and 11, at the Candolim property.
The GCZMA informed the Bench that it will take prompt steps/action and that the premises where the construction has been undertaken by the respondent for the said event (commercial event), will be sealed.
