PANJIM: The High Court of Bombay at Goa on Thursday directed the Goa Municipalities Appellate Tribunal to decide within next two months, on the appeal filed by the Quality Exports and two others from Cuncolim industrial estate.
Patrick Monteiro and another had filed a writ petition before the High Court challenging the impugned order passed the Municipal Appellate Tribunal granting ad-interim stay to the demolition.
Arguing on behalf of the petitioners, Adv Sahil Sardessai said that the impugned demolition was stayed by the Tribunal despite the petitioner filing a caveat and in spite of service to the respondent. He told the Court that no notice was issued to him and that the Tribunal has now fixed the matter for hearing on merits. He prayed for directions to the Appellate Tribunal to decide the said appeal as expeditiously as possible.
But since the petitioners had appeared before the Appellate Tribunal, the Court directed the Tribunal to decide the appeal within a period of two months from the date of receipt of the order of the Court and dispose of the writ petition.
In January this year, the Goa Municipalities Appellate Tribunal had dismissed the appeal filed by the Quality Exports against the order of the chief officer of Cuncolim Municipal Council directing the Quality Exports to demolish the illegal construction after the appellate failed to prove the legality of the construction.
