HC dismisses Siolim Pastor’s criminal revision application

PANJIM: The High Court of Bombay Goa dismissed the criminal revision application filed by Pastor Domnic D’Souza of Tropa Waddo, Sodiem-Siolim, challenging the order passed by the Special Court for CBI at Mapusa, rejecting his request for issuing process under Section 156(3) of the CrPC.

D’Souza had prayed that the magistrate be directed to investigate his complaint against the accused involved in committing cognisable offence. He had sought inquiry against the Sodiem-Siolim panchayat for carrying out construction by collecting ‘popular contribution’ and alleged misappropriation of funds.

Earlier, the Special Court for CBI at Mapusa had dismissed his application observing that the applicant had made a vague allegation that the construction had been carried out by the Sarpanch and Deputy Sarpanch of Sodiem-Siolim by collecting ‘popular contribution’. His contention was based on the statement made by the Block Development Officer (BDO) in his letter dated May 25, 2010 but the Court stated that it does not find support from the report made by inspection team. None of the contributors who had allegedly contributed to said popular contribution, made any grievance about the swindling of the funds, allegedly collected by way of ‘popular contribution’.

However, the High Court Judge Justice Avinash Gharote said that the petitioner had failed to point out any material to indicate that any of the members of the gram panchayat had ever demanded any funds from any person.
