PANJIM: The High Court of Bombay at Goa has enhanced the market value of the land acquired for the purpose of the construction of the left bank main canal of the Tillari Irrigation Project from Rs 34 per square metre to Rs 48 per square metre.
The Special Land Acquisition Officer, Mapusa pursuant to a notification published in the Official Gazette on July 4, 1991, had acquired lands in the Village Latambarcem in Bicholim taluka and comprised of an area admeasuring 2,400 square metres forming part of the land under survey number 6/2 and an area of 3,225 square metres forming part of the land under survey number 7 at a rate of Rs 10 per square metre.

However, the land owners filed an appeal for enhancement of rate before the Competent Authority, who by the judgement and award dated June 29, 2011 enhanced the rate from Rs 10 per square metre granted by the Land Acquisition officer to a compensation of Rs 34 per square metres which the Special Land Acquisition Officer (SLAO) challenged before the High Court.
The High Court while dismissing the appeal filed by the SLAO, further enhanced the rate from Rs 34 per square metre to Rs 48 per square metre, Further the respondents will be entitled to an amount calculated at 12 per cent per annum on such market value for the period commencing on and from the date of publication of the notification to the date of the award of the Collector or the date of taking possession of the land, whichever is earlier.
The HC has also held that respondents will be entitled to the interest on the excess of the compensation at 9% per annum for the first year from the date on which the Collector took possession of the land to the date of payment of such excess amount into the Court and 15% per annum for the second year till the excess sum or part thereof remain unpaid.
