PANJIM: The Bombay High Court at Goa has issued notices to the respondents in the writ petition that had been filed by the Assistant Engineers Association objecting to the alleged injustice done to the Association by alleged illegal arbitrary separation of the seniority list amongst Assistant Engineers holding degrees and Assistant Engineers holding diplomas in the same cadre.
The Association had filed the case against the State of Goa represented by the Chief Secretary, Principal Secretaries of Power, Law and Personnel along with the Chief Electrical Engineer (CEC) of the Electricity Department.
The case was taken by Division Bench headed by Chief Justice Dipankar Datta and Justice M S Sonak while Attorney General Devdas Pangam said he would appear only for the State and not the private respondents, that is the 102 Assistant Engineers.
Following directions from the Bench, an amendment was incorporated following which the Hight Court, issued notices to the 102 Assistant Engineers.
The Association alleged in the petition that the separate seniority list is illegal and violates the Fundamental Right under Article 14 and 119 of the Constitution. They added that separate seniority list is also a completion violation of the Government of Goa Seniority Rules 1967 and violation of the judgement and order of the Supreme Court in 2014 in the matter of K.K Dixit and others versus the Rajasthan Housing Board and others.
The petitioners have further alleged that the illegal act of separate seniority list carried out by the office of CEC of Electricity Department in connivance with the Law Department and Personnel Department is affecting the future of 102 Assistant Engineers in the Electricity Department.
