HC issues show cause notice to PWD Asst Eng for ‘obstructing’ implementation of Court orders

PANJIM: The High Court of Bombay at Goa on Monday issued a show cause notice to the PWD, Works Division VI (roads) assistant engineer for ‘obstructing’ implementation of Court’s demolition orders in and around the funnel zone of the Dabolim International Airport. 

The Court also directed the Director of Panchayats to inquire/verify if the Chicalim sarpanch had built illegal constructions within the area and to submit a detailed report before the court in this regards latest by July 24. Also both – the sarpanch and the panchayat secretary have been asked to remain present during the next hearing and explain why demolition orders were not executed.

Following an affidavit filed by the Mormugao Planning and Development Authority (MPDA) member secretary Ritesh Shirodkar while hearing a contempt petition filed by Alexander J Michael, the Court pointed out that the demolition squad which was to be provided by PWD assistant engineer, Fatorda, reached the site on one occasion without requisite tools and equipment, and that he remained absent on the second occasion when the officials of MPDA and the Indian Navy had arrived at the site to demolish the structures. 

In view of this, the Court has issued a show cause notice to the assistant engineer asking him as to why proceedings for contempt of court should not be initiated against him. 

The assistant engineer has been asked to remain present along with his reply on July 24. 

As many as 105 structures have been identified to be failing within the funnel zone of Dabolim airport.
