HC notice to GCZMA on review powers

PANJIM: The High Court of Bombay at Goa on Thursday issued notices to Goa Coastal Zone Management Authority and others to respond whether it has power to review decisions. The notices are returnable on July 31, 2018. 
The Division Bench of Justice Prithviraj K Chavan and Justice N M Jamdar has directed GCZMA not to go ahead hearing the matter of demolition of hotels of Sheila Dhody.
If GCZMA proceeds to hear the matter further, the HC will consider the question raised by the petitioner as regards the existence or otherwise of powers of review and deal with the same, the order says. 
Petitioner Kashinath Shetye had submitted that a decision was taken by GCZMA on February 28, 2017 whereby the demolition has been ordered. 
He further stated that despite this decision, at its meeting on April 182017, further representation and additional documents requesting for an opportunity to put forward the case in detail in respect of the private respondent was sought. 
Shetye stated in his writ petition that exercising of powers of review do not vest in the Authority. He further pointed out that when the decision was taken on February 28, 2017, the private respondent was heard through an advocate.
