PANJIM: The High Court of Bombay at Goa has rejected the anticipatory bail application of Rony Robert D’Souza, who apprehended arrest in connection with an attempted murder case involving history sheeter Suryakant Kambli.
While passing the order, Justice Bharat P Deshpande took note of the objections raised by the Panjim Police.
Justice Deshpande observed that many cases are already pending against D’Souza and if it is found during the investigation that his involvement exists in this case, then it will also be said that while enjoying bail in other cases, he is indulging in the commission of another offence.
Justice Deshpande said at the stage of an investigation, statements of any suspect could be considered as a further clue or a guiding factor to proceed even in the investigation.
Two minors were arrested by Panjim Police in connection with the attempted murder case involving history-sheeter Suryakant Kambli. The Police had taken the minors into custody on December 13 last year.
Opposing the anticipatory bail application, police through its counsel Additional Public Prosecutor Pravin Faldessai submitted that after registration of the FIR and on verifying the CCTV footage, two juveniles were apprehended.
On interrogation of the juveniles, it was disclosed that attack on the victim was allegedly at the instance of D’Souza and that too because of previous enmity between the two, the police submitted.
Police stated that the weapon used in the assault had been deposited with D’Souza and the applicant was a habitual offender and in all nine cases were pending against him in Panjim Police station itself.
Police said that D’Souza was allegedly involved in three chapter cases and it could be the modus operandi of the applicant who is very well aware that if any such act is done through a minor, such minor is not liable for punishment.
D’Souza through his counsel K Raikar submitted that there was absolutely no material against him in connection with the offence registered at Panjim Police Station on a complaint filed by Suryakant Kambli.
