PANJIM: The Bombay High Court in Goa has overturned Sancoale village panchayat’s decision to revoke a construction project’s No Objection Certificate (NOC). The court has ordered the panchayat to conduct a new hearing with the applicant within the next three months.
This decision comes following a writ petition filed by Francisco Fernandes, represented by Madhav Vishnu Talak.
The court invalidated the panchayat’s resolution from December 14, 2018, as well as orders from the Additional Director of Panchayat-II, South Goa, and the Principal District Judge, South Goa, on August 17, 2021, and March 14, 2023, respectively.
Additionally, the court has instructed the panchayat to provide a hearing to the petitioner before making any decisions regarding the NOC revocation.
The petitioner had previously been granted a Final NOC for property development, which was later revoked by the panchayat due to unauthorised encroachments.
The panchayat was also instructed to make an appropriate decision on the petitioner’s complaint within a fortnight; otherwise, the resolution from December 14, 2018, would remain in effect, and the panchayat was directed to take action in accordance with the law.
