HC upholds NDPS order

PANJIM, SEPT 9 The Bombay High Court at Goa has upheld the order of the Narcotics Drugs Psychotropic Substances, Court Mapusa wherein one Vincy Pereira was convicted and sentenced to ten years rigorous imprisonment and fined Rs 1 lakh. He has to undergo further imprisonment of one year if he fails to pay the fine.

The Bombay High Court at Goa has upheld the order of the Narcotics Drugs Psychotropic Substances, Court Mapusa wherein one Vincy Pereira was convicted and sentenced to ten years rigorous imprisonment and fined Rs 1 lakh. He has to undergo further imprisonment of one year if he fails to pay the fine.
Justice N A Britto dismissed the appeal filed by the accused on the ground that there was no merit in the appeal. According to the prosecution, the accused was on December 21, 2006 found in possession of 5.200 gram of charas near football ground in Parra.
He had come to make the delivery to prospective customer and police inspector Suraj Harlarnkar attached to Anti Narcotics Cell, acting on prior information had caught him red handed.
He was convicted under section 20 [b][ii][c] of the NDPS Act, 1985 while he maintained that he was falsely implicated.
He was convicted on strong evidence of witnesses and other corroborative evidence. And thus, High Court upheld order of the lower court while dismissing his appeal. Public Prosecutor Winnie Coutinho appeared on behalf of the government.
