Adv Aires Rodrigues had filed application to the court seeking contempt of Court and perjury proceedings against Prabhudesai.
Adv Rodrigues in his application has pointed out to the Court that Inspector Rajendra Prabhudesai on August 11 while seeking further eight weeks to investigate the case had made a false and misleading written submission to the court that the file of Serula Comunidade for regularisation of encroachment of land in respect of Dilip Parulekar was pending before the North Goa Collector.
“Inspector Rajendra Prabhudessai should not have misled the Court and that making such false statements only reveals Inspector Rajendra Prabhdessai’s rank audacity and disrespect to the Majesty of the Court,” said Adv Rodrigues.
The application also states that in making false statements Inspector Rajendra Prabhudesai had only further proved that while acting as a caged parrot he was mischievously trying to derail the investigation so as to help the alleged accused Dilip Parulekar who is the Tourism Minister.
of Goa.
Adv Rodrigues in his application has further sought that Inspector Rajendra Prabhudesai’s conduct being in clear Contempt of Court that the matter be referred to the Bombay High Court under Section 15(2) of the Contempt of Court Act for appropriate orders and also for perjury under Sectionn196 of the Indian Penal Code.
On a petition filed by Adv Rodrigues under Section 156 (3) of the Criminal Procedure Code, the Mapusa JMFC on January 16 last year had directed the Porvorim Police to register an FIR for offences under sections 119, 120, 420 read with 120-B of the Indian Penal Code, against Tourism Minister Dilip Parulekar, Peter Martins, then attorney of Comunidade of Serula and Mrs Irene Sequeira, then Administrator of Comunidade of North Zone.
The investigation of the case was later transferred to the Crime Branch but as the police were deliberately flouting the Court order and not investigating the case for over six months, Adv Rodrigues later sought that the Court monitor the investigation as the accused Dilip Parulekar was politically very influential and the Tourism Minister of the State.
