High Court directs to de-seal four shacks in Anjuna-Caisua Panchayat jurisdiction

Orders p’yat to first allow applicants to remove goods and other articles, then dismantle shacks

PANJIM: The High Court of Bombay at Goa on Tuesday directed the Anjuna-Caisua village panchayat to de-seal four shacks and allow the applicants to remove goods and other articles and to dismantle the shacks later.

Four persons Premanand Agarwadekar, Vijay Shirodkar, Eknath Govekar and Pushparaj Govenkar had filed civil applications seeking to de-seal their shacks so that they could remove goods and articles lying inside on account of the onset of monsoon. These shacks were situated at Ozrant Beach, Chapra Beach and Vagator Beach. These shacks were sealed as per the directive of the High Court while hearing a public interest litigation (PIL) suo motu on illegal constructions. 

However, on May 6, the division bench had ordered the Anjuna-Caisua village panchayat to de-seal a shack at Vagator Beach and to ensure that the same was dismantled. 

The court had said that it is the responsibility of the village panchayat to ensure that no activities, including commercial ones, are undertaken once the shack is dismantled. 

The village panchayat was also asked to file a compliance report along with photographs at the next hearing.

In view of the directions, Justice Jitendra S Jain allowed the four civil applications and directed the Anjuna-Caisua village panchayat to de-seal the shacks and ensure that the same is dismantled. 

Further, the Court directed to ensure that no activities including commercial ones, are undertaken after the shacks are dismantled.
