JMFC asks prosecutor to submit reasons for withdrawing Velim Church case

MARGAO: The Velim Church attack case of 2012 has taken yet another twist, with the Judicial Magistrate First Class, Margao, asking the public prosecutor to place the reasons for withdrawing the case before the court.

 The JMFC, on Monday, issued notices to the injured police officials for appearance and also asked to keep material on record to back the withdrawal. The case has been now kept for appearance of the injured on July 6.
The 22 accused in the case had breathed a sigh of relief after the government issued issued a letter for withdrawal of the case. However, the Court has now asked the public prosecutor to satisfy it before the withdrawal is executed.
According to Advocate Rajeev Gomes, who has been appearing for the 22 accused, the court has asked the prosecution to place on record the material on the basis of which the PP has concluded the matter for withdrawal.
“Notices to the injured have been issued and they have been asked to appear to record their say in the matter,” said Gomes.
Incidentally, Advocate Aires Rodrigues has objected to the manner in which the case has been handled by the prosecution and has also filed an application questioning the same.
It may be recalled that, on February 26, 2012, then Special Branch Officers PSI Kapil Nayak, along with head constables Krishnanand Rane and Kuldeep Desai, while in the Velim Church, got into a tussle with the locals, leading to tension that ended with five policemen being injured – two seriously – after allegedly being attacked by Velim locals.
The incident, which happened on the face of the 2012 Assembly elections, may see yet another election as lots of procedures remain to be completed. All the accused have already been charge-sheeted in the case.
