JMFC directs Parulekar to remain present on Aug 16

MAPUSA: Mapusa Judicial Magistrate First Class, Shantashri Kudchadkar on Monday directed former minister, Dilip Parulekar and two other accused namely Peter Martins, then attorney of Serula Comunidade and Irene Sequeira, then Administrator of Bardez Comunidade to remain present in Court on August 16 at 10 am.  
The trio is required to furnish surety and face trial in the Serula Comunidade cheating and land grab case filed against them by Adv Aires Rodrigues.
Despite being directed by Justice C V Bhadang of the Bombay High to appear on August 6 and face trial for offences under Sections 119, 120, 420 read with 120-B of the Indian Penal Code, the trio remained absent.
Adv Rodrigues drew the JMFC’s attention that Parulekar in collusion and connivance with government authorities and Crime Branch has been successful in dragging this case against him for over four years.
On January 16, 2014, acting on a petition filed by Adv Rodrigues, the Mapusa JMFC directed the Porvorim Police to register an FIR against Dilip Parulekar, Peter Martins and Irene Sequeira.
In his complaint, Adv. Rodrigues had drawn the Court’s attention that 599 sq mts of prime land on the CHOGM Road at Porvorim was given to Dilip Parulekar without any auction and without following the procedure contemplated under the Comunidade Code. The whole intention was to fraudulently facilitate the doling out of prime comunidade land to Parulekar. 
He stated that the Serula Comunidade granted this land to Parulekar for a mere Rs 3, 41,320 though its value was worth over a crore.  
The case against Parulekar was initially probed by the Porvorim Police and later transferred to the Crime Branch.
, which in 2016, sought to close the case but this move was rejected by the North Goa Principal District and Sessions Judge.
Strongly opposing the move to close the case, Adv Rodrigues had submitted to the court that the Crime Branch in an attempt to shield Parulekar had derailed and vitiated the investigation by falsely and malafidely portraying to the court that Parulekar was a poor victim who was misled by the Comunidade officials to grab the land.
