John refused bail again

The Bombay High Court at Goa today rejected bail plea of John Fernandes, a South Goa based politician arrested for allegedly raping a Russian girl at Colva.
Justice Nelson Britto rejecting the bail stated that the court cannot grant bail to the accused as the victim is yet to be examined by the lower court.
25-year-old Russian girl will depose before the South Goa Session Court in December, 2010.
Justice Britto during the hearing had also pointed out that there are chances that the accused will threaten the victim if the bail is granted.
At the time of hearing, Public Prosecutor had brought to the Court notice that the victim friend, who is the key witness in the case, was manipulated by the accused.
John, currently in judicial lock up, is accused of raping 25 year old Russian girl by spiking her drinks at Colva beach last year.
The police had told Court that John had destroyed the crucial evidence in this case by cleaning the car and providing wrong clothes to the investigating agency.
The accused had moved the bail petition, this month.
Earlier, the Sessions Court had rejected his bail plea. He was accused under section 376 and 201 of Indian Penal Code (IPC) for rape and destruction of evidence.
Fernandes allegedly raped a Russian girl in his car after spiking her drinks December 1, 2009 when he met the girl at a shack in Colva beach. He was on run for a month after a complaint was registered against him.
He had surrendered on January 6, 2010.
An attempt to rape case was initially registered at Colva police station and was handed over later to the Crime Branch.
Crime Branch took the fresh statement from the victim and registered a rape case against Fernandes.
