PANJIM: The High Court of Bombay at Goa has sentenced a murder convict to life imprisonment and slapped a fine of Rs 20,000.
The Bench, in its order on December 6, overruled District and Session Court’s two-year-old verdict acquitting Yatin Tigade, who along with three men walked free in a murder charge.
The Division Bench of Justices M S Sonak and Nutan Sardessai held him guilty of the offence punishable under Section 302 (Murder) of Indian Penal Code. The High Court has issued warrant against Yatin Tigade because he was not present at the time of the order on Tuesday. At the last hearing, he was asked to remain present on Tuesday.
In September 2016, the trial court had acquitted Tigade, Ashraf Shaikh, Sandeep Shinde and Krishna Naik.
The fifth accused, a minor, meanwhile, was facing trial before the Children’s Court. The District Court acquitted the accused as the prosecution failed to prove the charges beyond reasonable doubt.
The case of the prosecution was that victim Salvador Fernandes alias Ghalu was a gangster based in Taleigao and had enmity with the rival gang comprising the five accused.
On August 27, 2011 Ghalu was assaulted with choppers.
near Goa Science Centre at Miramar and died in the hospital about a week later. Galu, who was at Miramar along with two other friends were initially chased by the accused. While the third person managed to escape, Ghalu and Manjunath Kambli got inside their car when they were brutally attacked.
The Maharashtra police had arrested the accused from Amboli check-post and handed them over to Goa Police.
