SANGUEM: Judicial Magistrate First Class, Sunita Gaunekar, has convicted Joshua S S Albuquerque for offences punishable under sections 279 and 338 of the IPC.
The conviction stems from a case of rash and negligent driving on January 18, 2021, near the Old Collectorate Building in Margao. Albuquerque was found guilty of driving a car in a reckless manner, resulting in a collision with a two-wheeler and causing injuries to the rider, Vaibhavi Vinay Dessai.
The accused, Joshua S S Albuquerque, has been sentenced to pay a fine of Rs 1,000 to the government within one month. Additionally, Albuquerque is fined Rs 10,000, to be paid to the injured Vaibhavi Vinay Dessai. Furthermore, the accused is sentenced to undergo simple imprisonment for one month under both Sections 279 and 338 of the IPC.
However, the substantive sentences have been set aside under Sections 4 and 5 of the Probation of Offender Act 1958. Instead, Albuquerque is directed to maintain good behavior for a period of six months. Investigating Officer Ranjitkumar Dessai carried out the probe.
