CALANGUTE: Adv Benny Nazareth, the lawyer of the beleaguered and trapped French actor Marianne Chicherio has filed a complaint against the PI at State Police Complaints Authority for not taking any action on her complaint of being tortured and harassed by “hired goons” of Nirmala Achaya e Souza, the widow of neither original owner Fransisco Souza, in whose lifetime Marianne was living peacefully in what she called and believed was her home.
There are three things, trespassing into the property, threat to kill and theft and damage. These things are not a civil matter, Adv Nazareth added.
“Police have taken zero action in this matter and are trying to get away by calling it a civil matter. I have also made a representation to the DGP, SP North and DySP requesting to direct the Calangute PI to take action, Adv Nazareth said.
If police fail to take action then will file a writ petition in the court, Adv Nazareth added.
The French woman has been residing in the house since 2009 and has a residential permit issued by FRRO.
There’s an acknowledgement receipt mentioning the owner (late Francisco) has received an ex amount of money and has given possession of the house to Marianne.
“It’s an attempt to dispossess the lady from the house,” Adv Nazareth pointed out.
Adv Nazareth informed that the police have not even registered a case of theft. The law is very clear. FIR has to be registered if it is a commission of a cognisable offence.
Police have used the trick of calling the French lady to the police station behind her back, allowing the culprits to enter the house. She is 75 years old so her statement should have been at her house and not at the police station.
