MARGAO: The Sessions Court has on Thursday ordered the Margao Municipal Council to conduct a sample test through GSPCB of the garbage lying inside the plant. The test is to ascertain whether the waste is excluded waste or inert to put an end to the dispute between Fomento and MMC. The MMC claims that the waste is inert which is to be dealt with by the Fomento and the Fomento claims that the waste is excluded waste which is the lookout of the MMC to cart away from the plant. The arrangement of the Rs 1 lakh per day payment to Fomento, however, continues till January 4, even as the concessionaire distances from the waste provided to it in the form they wanted.
The Principal District & Sessions Judge today ordered the MMC to write to the Goa State Pollution Control Board and make them take samples of the waste present inside the plant in presence of all the parties to ascertain whether the waste falls in Excluded or Inert category. This is to fix the responsibility of carting away the waste from the plant.
The MMC has been supplying segregated waste to the plant for quite some time and Fomento claims that the plant now has 900 tonnes of waste inside. They are asking the MMC to take responsibility to take away the waste as it claims it to be excluded waste. This demand comes even as the MMC has paid crores in money at the rate of Rs 1 lakh per day to the concessionaire for waste treatment.
Meanwhile the Municipal Lawyer, however, claims that he is trying to hold a HPCC meeting.
The Lawyer of the Concessionaire prayed before the court to take away the waste from the plant and claimed that the plant is choking. The Fomento lawyer has also sought to collect samples of the waste independently and conduct a test at a certified independent lab for which the judge agreed.
The MMC has also told the court that they would cart away the waste if it is proven to be excluded waste and not inert.
